In a heated dispute with some government lawyers over the existence of a cause of action. They cite, in support of their claims that the cause of action exists, a case from 2004. It was denying a 12(b)(6) challenge to a claim which is identical to the one our client faces, and which we do not believe there exists any authority.

I look at it, scratch my head, and then Shepardize it.

John Edwards Wants To Take Away Your Hunting Rifle

That would be John Edwards (Shithead - NC). In case you didn’t know it, he of the $400 haircuts has stooped to all sorts of levels of two faced pandering.

Earlier this week, he unveiled the latest in a long line of Democrat shams attempting to confuse whether the 2nd Amendment is about hunting or self preservation and the ability to take the country back from enemies of freedom like John Edwards.

Traveling in Iowa yesterday, Mr. Edwards unveiled a “Hunting and Fishing Bill of Rights and Responsibilities” that calls for giving hunters more access to federal lands, including, in some cases, national parks.

“This is part of who I am and part of what I will stand for as president,” Mr. Edwards told voters in Glenwood, Iowa, according to the Associated Press. He said he hunted while growing up in rural North Carolina and still fishes occasionally.

Jeff Soyer was all over this and pointed out the obvious:

While there’s nothing wrong with one of his suggestions, that local hunters be used to thin herds on federal land, certainly the only reason he brings this up is the same as John Kerry’s pathetic attempts to appeal to gun owners in 2004: To fool us into believing that he’ll preserve our right to keep and bear arms.

Still, Edwards was continuing to confuse the issue, and not likely to respond to a blogger for the truth (even if he is a gay blogger, not that there is anything wrong with that). Luckily, the good guys at Field and Stream (part of the Outdoor Life family of products) stepped up to the plate and delivered the goods - by way of an exclusive interview with John Edwards on his plans in for when elected. Its about what you would expect.

F&S: How do you plan on protecting gun rights and promoting gun safety?

JE: I think, first and foremost, that we need a president who actually believes in the Second Amendment and in the individual right to own firearms. And, the importance in that, both for hunting and for protection, and I do. I think part of it is the way of life that I grew up with, and the culture of which I grew up in. It’s been with me my entire life.

I think there are some reasonable things that we can do to make sure we keep guns out of the hands of people like that young man who did the killings at Virginia Tech. I think we can fill in some holes that exist in the system today. I haven’t met a hunter yet who needed an AK-47 to hunt, but I think we need to be very careful to make sure that the second amendment rights are protected.

Can you believe that? Wasn’t that awfully friendly of him?? He came right out and said it, no need for speculating on our part. John Edwards is nothing but the bigoted candidate of the discredited gun lobby.

I’m sorry not everyone can afford the $200,000 shotgun that you and your friends like John Kerry can no doubt afford. Does someone need an AK-47 to hunt? Obviously no, but thats no the point of the 2nd Amendment nor is it the point of choosing what to hunt with. I know plenty of folks who hunt with an SKS - and it uses the same round as an AK-47. In fact, I’ve been communicating with a prospective new hunter in Maryland who only owns an AK-47. Thats cool with me, I look forward to taking him out and enjoying the pleasure he feels while using that fine firearm to put food on his families table.
Heck, he’d probably say the same thing about the dreaded .50 caliber sniper rifle. Thing is, that’s exactly what I’ve been hunting deer with this early muzzleloader season.

What a horrid precedent. Just this morning, I dealt with some fuddy telling me i “didn’t need an inline” to go muzzleloader hunting. Is that what Edwards wants to do next??

Do I need a short magnumn?? Not by any stretch of the imagination, but is it John Edwards right to tell me what I can use??

Do I need that Remington .280 I intend to purchase this weekend? Hell no, my old .30-30 (remember that round??? Teddy Kennedy called it a police armor piercing round) does fine. But damn straight I’m gonna buy it!

I wouldn’t trust this POS 1 minute. Good on F&S for following up with him originally, but you shouldn’t have let him off on the old who needs an AK canard.

Waking up at 4:00 to a complete (and much needed) downpour - sucks

Thirty minute drive to stand taking an hour and a half because of heavy rain (and realizing you can’t turn back cause its the last day of marylands early firearms season) and then sitting in for 90 minutes in Noahs ark like down pour - major sucks

Seeing rain stop and 8 point buck you’ve been tracking walk across field 175 yards away and within range of your gun (thanks to the advice of folks at The High Road, some mathematics, a new ebay scope and a killer range session) only to realize its an antlerless only day - total and complete 100% suckage of all time.

Seeing forest and field come alive, discovering new trail and stand location, watching flock of geese fly in, and knowing there’s venison in the freezer - priceless.

Not quite Doug Flutieish in its last play glamor, but the total swing of events of the last two minutes and 11 seconds is right up there with Vinny Testaverde’s great comeback against the Dolphins.

In fact, when Lamar Smith scored with 12 seconds left in the third quarter to give the Dolphins a 30-7 lead, Fiedler walked over to Jason Taylor and told him the game was over. Little did Fielder know that Taylor was being miked by Monday Night Football. Or that he just jinxed his team.

And how cool is it that I’ve seen all three of what will go down as the greatest comebacks in football?

I can live with that, and in fact think Ron Paul has some built in advantages that Nader didn’t, starting with a pretty established (albeit dysfunctional) party to support his efforts (and hence he won’t need to spend valuable time and resources engaged in an effort to do things Nader had to, like fight Al Gore’s efforts to keep him off the ballot).

With the left ticked off at Hillary, what are the chances they run Nader or someone else on the Green ticket again??

Tom Davis is a turd.

And clueless.

Davis also acknowledged that his swipes at his own party will probably help his wife, state Sen. Jeannemarie Devolites Davis (R-Fairfax), who is in a bruising reelection campaign against Democrat J. Chapman Petersen. A win for Devolites Davis with her husband’s help in an overwhelmingly Democratic district would send a powerful message to Republicans that the Davises’ message of moderation and consensus-building on such issues as gun control and highway funding is the proper model.

I don’t really care about the other stuff. Duh. I’m willing to accept people having different points of view. Thats cool. Its what this country is founded upon, but this turd hasn’t a clue about what is important or not. Gun control is my litmus test, because it is the foundational right by which all my other rights - rights directly descended from god and inherent in nature - are protected.

But this statist, nativist (in the most base, Washingtonian terms) prick doesn’t get it.

He thinks our rights, our civil and natural rights, are simply another chit to be negotiated for or against. He’s clueless in thinking gun control is a conservative Republican issue. It isn’t. There are plenty of worthwhile Democrats who get it. Like his wife’s opponent Chap Petersen.

Not only do Tom Davis and his wife not get it, but they think they are above public scrutiny.

Last night, October 8th, we held a debate at Old Town Hall in downtown Fairfax. Funny thing is … my opponent Senator Devolites-Davis chose not to attend.

Debates at Old Town Hall have a long history in our community. I have been attending them since I was a child and my Dad was running for Fairfax City Council. It is traditional for Delegates and Senators to schedule one. Delegate Jack Rust and I had one in 2001, when I was the Democratic challenger. It was a contest I won’t soon forget, as he was an excellent debater.

The debate last night had been set for over a month. The City Republican and City Democratic Committees were joint sponsors. Both campaigns had it scheduled and Old Town Hall was reserved.

Last week, the Devolites-Davis campaign asked for a ban on recording devices. Of course, we refused. This is a public debate for a public office. Recording debate statements is standard, especially when candidates have a tendency to stray from the truth in their remarks.

I found out over the weekend that the Devolites-Davis campaign would not appear. It was too late to cancel the event so we had a Town Hall instead with 100+ people. They deserved better.

Weak.

Here’s what Chap had to say on the gun issue.

As far as schools, the state law is clear. It is a Class 6 felony in Virginia to possess a firearm on school property. I support that law.

In 2003, the legislature unanimously passed an exception to the law for guns in the locked trunk of a vehicle in a school parking lot. That bill was signed by Governor Warner.

In 2005, the legislature used the “parking lot” exception to include concealed-carry permit holders who arrived to pick up a child. The scope of that bill (HB 2535) was expressly limited to parking lots and driveways. I voted for the bill, it passed by a large margin, and Governor Warner signed it.

The purpose of the bills was to ensure that inadvertent possession of a firearm on school property did not lead to a life-altering felony conviction. While I believe that guns have no place in school, I also recognize that a “one size fits all” law would turn unwitting citizens into felons. As a lawyer and a parent of school children, I made that choice carefully.

He’s not perfect, but he’s straightforward and honest and willing to stand by his record which is far more than your gonna get with any other politician - especially one of the Devolites-Davis ilk.

Senator Devolites-Davis is familiar with the Dillon Rule. In fact, in 2004 she voted “yes” to confirm the state’s prohibition on local gun laws. Her attack on me is contradicted by her own voting record!

I’m was invited to dine at the White House Mess next week :)

There are two annexes off the main mansion. The West Wing, containing Presidential offices, was destroyed in a fire in 1929. It was completely rebuilt and now contains the Oval Office, the Cabinet Room, and offices for the President’s principal aides. Three dining rooms on the lower level of the West Wing, known as the White House Mess, can serve almost 100 staffers at a time. The Rose Garden, outside the President’s office, was created during the Kennedy Presidency.

Cool. I’ve been there twice before. First time, in the waning days of the Clinton presidency I met with one of Bill’s personal lawyers to work out the terms of a pardon for a client (yes, that scandal). The second time was last year, where a friend invited me to lunch and I literally bumped into Karl Rove as he was coming out of his office, reading something and not paying any attention, and racing off to meet Dick Cheney at the bottom of the stairs. Neither Darth Vader nor the Evil Emperor were anything but charming and apologetic.

I had just started my sophmore year at the Morristown Beard School. A Prep School Hippy, just digging it all. Had seen probably maybe a half dozen shows before this run, the highlight of which was probably the killer 3 set Dylan and Dead show at Giants Stadium that July. Mostly a social thing still, and while it wouldn’t really be until the fairgrounds/raceway in Maine the next August that I was set off on the 20+ year trajectory I still haven’t recovered from, this wild and crazy weekend in NY City (Friday, Saturday, and Sunday) put me right on that path.

So, I’m sitting here, on the edge of a corn field in my tree stand in suburban Maryland (Montgomery County, nonetheless) sitting with my evil 50 caliber sniper rifle on the lookout for deer (you have any idea how much it sucks to be hunting deer in 80 degree weather?) And low and behold, I find myself under the flight pattern for Dulles Airport. Averaging about a plane every 45 seconds.

Guess what??? Somehow my evil-50-caliber-plane-shooting-down-sniper-rifle hasn’t taken a single shot all day (let alone killed anyone or thing) or taken down a plane.

Bill Pascrell (D-NJ, and you know what that means) is on the floor of the House right now talking about the pressing need to turn the Great Falls of Paterson, NJ into a National Park. There are tremendously compelling reasons, as Paterson was the birthplace of the American Industrial Revolution and the Falls were the driving force behind that.

Amongst the reasons, indeed the first and most compelling reason he listed, was that Paterson was the location in which Samuel Colt developed the Colt Revolver and laid the groundwork for America’s westward expansion and world beating industrial mights.

Thats an awfully favorable impression of the often times beleaguered (well, in New Jersey) firearms industry.
